At the proposal of the Ministry of Justice, an amendment will be made to the Law on Court Budget.
With the new Draft Law on Amending the Law on Court Budget, the proposer Ministry of Finance, proposes amendments to the Law on Court Budget from 2003.
In the explanation given by the proposer, the needs for enactment of the Law on Amendments to the Law on Court Budget were proposed to eliminate all identified shortcomings. The need and shorcomings were identified during the application of the Law on Court Budget from 2003.
Namely, in 2003, the Law on Judicial Budget was adopted, which regulates the matter of financing the judiciary in all its aspects, starting from the planning, through the procedure for adopting of the budget, until its execution. For that purpose, the Judicial Budget Council was established, composed of representatives of the judiciary with competencies in the field of court budget. The adoption and implementation of this law has significantly strengthened the independence of the judiciary in this segment, especially since the financing of the judiciary is one of the basic preconditions for its independence.
Furhtermore, according to the proposer, the adoption of the proposed law will create an opportunity to strengthen the independence of the judiciary and will also eliminate the weaknesses located in the implementation of the previous law. It is envisaged that changes will be implemented with the help of the Judicial Reform Support Project through the IPA Fund.
The set time frame for preparation of this Draft Law on Amending the Law on Court Budget is from 10.05.2021 to 30.06.2021, and no public debate has been announced.
